INTRODUCTION

In this Privacy Policy, “we”, “us”, and “our” shall refer to Sylvan In-Home, LLC (“Sylvan In-Home”) and its affiliates; “you” and “user” shall refer to any person or entity which views, uses, or accesses the Sylvan In-Home Websites (www.sylvaninhometutoring.com, signin.sylvaninhometutoring.comparent.sylvaninhometutoring.com and tutor.sylvaninhometutoring.com), and its associated mobile application (collectively, the “Sites”), including, without limitation, parents, students, and tutors. This Privacy Policy describes:

  • Information that we receive from you when you interact with the Sites;
  • How we use and process the information that we receive
  • If and why Personal Information (defined in more detail below) may be disclosed to third parties; and your choices regarding the collection and processing of your Personal Information.

Please note that this Privacy Policy does not apply to information collected by other means or through third-party websites or services that you may access through the Sites. We encourage you to view the privacy policies of the other websites you view and use.

PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. When you submit information to or through the Sites, you consent to the collection and processing of your information as described in this Privacy Policy. By using the Sites, you accept the terms of this Privacy Policy and our Terms of Use and consent to our collection, use, disclosure, and retention of your information as described in this Privacy Policy.

This Privacy Policy is incorporated into and made a part of our Terms of Use.

The Effective Date of this Privacy Policy is set forth at the top of this Policy. Whenever possible, we will provide you with advance written notice of our changes to this Privacy Policy. We will not make retroactive changes that reduce your privacy rights unless we are legally required to do so. Your continued use of the Sites after the Effective Date constitutes your acceptance of any amendments to the Privacy Policy. Any amended Privacy Policy shall supersede any previous versions.

INFORMATION WE COLLECT

We collect various kinds of information that you provide to us, as well as information we obtain from your use of the Sites. Some of the types of information that we collect include:

  • Personal Information” — information associated with or used to identify or contact a specific person, including:
  • Contact data (such as e-mail address, telephone number, and employer information);
  • Demographic data (such as gender, date of birth, and zip code);
  • Certain Usage Data (defined below);
  • Registration data (such as information you provide when you register your account and create a profile, including uploaded content, profile descriptions, preferences, school information, etc.);
  • Account data (such as information related to scheduling of sessions);
  • Data from other sources (such as information from credit bureaus, mailing list providers, and publicly available sources, and certain Facebook or Google information, including, without limitation, profile information, friends list, and pictures, of users who elect to login using credentials from such third-party sign-in services if and at such time as they become available on the Sites);
  • Location Data – category of Personal Information collected about the location of a mobile device or computer, including:
  • The location of the mobile device or computer used to access the Sites derived from GPS or Wi-Fi use;
  • The IP address of the mobile device or computer or internet service used to access the Sites;
  • Other information made available by a user or others that indicates the current or prior location of the user;
  • Usage Data – information about a user’s online activity that, by itself, does not identity the user, such as: technical information (such as browser type, service provider, IP address, operating system, and webpages visited);
  • Search information (such as any historical data related to searches you have conducted while using the Sites);
  • Metadata (defined as information related to items you have made available through the Sites, such as the date, time, or location where you accessed the Sites);

Generally, we do not consider Usage Data as Personal Information because Usage Data by itself usually does not identify an individual. Personal Information and Usage Data may be linked together. Different types of Usage Information also may be linked together and, once linked, may identify an individual person. Some Usage Data may be Personal Information under applicable law. If you want to stop the collection of your Location Data, you may do so by adjusting the privacy settings on your browser and uninstalling the Sylvan In-Home mobile application.

Sylvan In-Home may share information which does not include your Personal Information with certain third parties in order to enhance the Sites. Although some browsers allow you to indicate that you do not want certain activities tracked, we are not currently obligated or able to comply with such indications and we may not do so. Sylvan In-Home cannot control the security of information generated by a user through certain third-party services and social networking sites.

Certain third parties that work with Sylvan In-Home may also collect your Personal Information on our behalf. For example, but not as a limitation, Stripe Connect may collect payment information from parents and tutors, and Checkr may collect your Social Security Number, Federal Employer Identification Number (if applicable), date of birth, and other such information for background check purposes for tutors. We urge you to review their privacy policies at https://stripe.com/us/connect-account/legal and https://checkr.com/privacy-policy, respectively.

Certain Personal Information which may be collected by Sylvan In-Home or its third-party partners, such as information about personal educational records and bank account information,  may be characterized as “Sensitive” and subject to stricter regulation than other personal information. Before providing it to us or to any third party, we urge you to carefully consider whether to disclose such Sensitive Personal Information. If you do provide Sensitive Personal Information to us, you consent to its use and disclosure for the purposes and in the manner described in this Privacy Policy.

HOW WE COLLECT INFORMATION

Whether we collect certain types of information and how we process it depends on how you use and access the Sites. Some information is collected automatically through use of cookies and similar data collection tools. We collect information about you in the following ways:

  • From You: we collect information from you when you:
  • Use the Sites – we collect Personal Information from you when you create an account to use the Sites, contact us for help or information, submit information or content directly to us, or otherwise voluntarily provide your Personal Information;
  • Connect with social media though the Sites – the Sites may offer you the ability to use Facebook Connect or other social media services (collectively, “Social Media”) in conjunction with certain aspects of the Sites, and when you access the Sites through your Facebook or other Social Media account, we may, depending on your privacy settings, have access to information that you have provided to the Social Media platform and store and/or use this information for the purposes set forth in this Privacy Policy;
  • Participate in a contest – the Sites may provide an opportunity to participate in a sweepstakes or contest, or to complete a customer satisfaction or market research survey, and we may use any information that you provide to us in the course of such contest participation or survey submission in the manner described in this Privacy Policy.
  • From Our Business Partners and Service Providers: third parties that assist us with our business operations also collect information (including Personal Information and Usage Data) about you through the Sites and share it with us (e.g., certain partners collect and share information with us to help us detect and prevent fraud). We will not sell or use any such Personal Information for any purpose not described in this Privacy Policy; however, we cannot make any representations or warranties about third parties’ sharing or use of such information, and we encourage you to read and review their privacy policies accordingly.
  • Automatically: we automatically collect certain types of information from you when you interact with the Sites, including the following:
  • Usage Data;
  • Information derived from cookies, web beacons, server logs, and other tools (collectively, “Data Collection Tools”) – we, along with certain third parties, use small text files which are sent to or accessed from your web browser or your computer’s or other device’s hard drive that contain information about such device, such as user ID, settings, browsing history, and activities conducted while using the Sites, in order to help us track users’ habits and experiences in order to improve the Sites;

We may combine the information we collect from you with the information we obtain from other sources, and use the aggregate information in accordance with this Privacy Policy.

Some web browsers (including some mobile web browsers) provide settings that allow a user to reject cookies or to alert a user when a cookie is placed on the user’s computer, tablet or mobile device. Although you are not required to accept cookies or mobile device identifiers, blocking or rejecting them may prevent access to some features available through the Sites.

HOW WE USE YOUR INFORMATION

We may use the information we collect for any of the following purposes either in an individualized or aggregated manner:

  • To provide the Sites to you;
  • To operate, improve and personalize the products and services we offer, and to give each user a more consistent and personalized experience when interacting with us;
  • For customer service, security, to detect fraud or illegal activities, or for archival and backup purposes in connection with the Sites
  • To communicate with you via e-mail and telephone;
  • To communicate with you via live chat options which may be offered through the Sites;
  • To better understand how users access and use the Sites, for the purposes of trying to improve the Sites, and to respond to user preferences, including language and location customization, personalized help and instructions, or other responses to users’ usage of the Services;
  • To help us develop our new products and services and improve our existing products and services;
  • To provide users with advertising and direct marketing that is more relevant;
  • To enforce our Terms of Use and other applicable policies; and
  • To assess the effectiveness of and improve advertising and other marketing and promotional activities on or in connection with the Sites.

HOW WE SHARE AND DISCLOSE YOUR INFORMATION

We may share and disclose information as described at the time information is collected or as follows:

  • When you consent: we may share Personal Information with third parties if you have given us your consent to do so, and we will only share Sensitive Personal Information when you have given us your opt-in consent;
  • To perform services: we may disclose Personal Information to third parties in order to perform services requested or functions initiated by users, such as scheduling tutoring sessions;
  • To identify a user: we may disclose Personal Information in order to identify a user in connection with communications sent through the Sites, and we may offer users the opportunity to share information with friends and other users through the Sites;
  • With third-party service providers performing services on our behalf: we share information, including Personal Information, with our service providers, including tutors, to perform the functions for which we engage them;
  • For legal purposes: we may share information that we collect from users, as needed, to enforce our rights, protect our property or protect the rights, property or safety of others, or as needed to support external auditing, compliance, and corporate governance functions; we will also disclose Personal Information as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental request, or other legal or regulatory process, or as required to pursue available legal remedies to which we may be entitled;
  • In aggregated form: we may share Personal Information about you in an aggregated form—that is, in a statistical or summary form that does not include any personal identifiers—with third parties in order to discover and reveal trends about how users like you interact with the Sites;
  • During corporate changes: we may transfer information, including your Personal Information, in connection with a merger, sale, acquisition, or other change or ownership or control by or of us or any of our affiliated companies, in whole or in part; however, if one of these events occurs, we will use reasonable efforts to notify you before your Personal Information may become subject to a different privacy policy.

INFORMATION STORAGE AND SECURITY

We retain information as long as it is necessary and relevant for our operations. We also retain Personal Information to comply with applicable law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Use, collect any fees owed, and other actions permitted by law. After it is no longer necessary for us to retain information, we dispose of it according to our data retention and deletion policies.

We employ industry-standard security measures designed to protect the security of all information submitted through the Sites. However, the security of information transmitted through the internet can never be guaranteed. We are not responsible for any interception or interruption of any communications through the internet or for changes to or losses of data. Users of the Sites are responsible for maintaining the security of any password, user ID or other form of authentication involved in obtaining access to password protected or secure areas of any of our digital services. In order to protect you and your data, we may suspend your use of the Sites, without notice, pending an investigation, if any breach of security is suspected. Access to and use of password protected and/or secure areas of any of the Sites are restricted to authorized users only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution.

YOUR RIGHTS

It is important to us that you are able to access and review the Personal Information we have about you and make corrections to it, as necessary. You can visit your account to manage and correct some of the information we have on file about you; however, once you submit certain information, you will not be able to modify it independently without the help of a Sylvan In-Home representative. You will also be able to opt-out of certain marketing and promotional communications by changing certain settings in your account. LINKS TO OTHER SITES

The Sites may contain links to third-party websites and services (“Third-Party Services”) with which we have no affiliation. A link to any Third-Party Service does not mean that we endorse it or the quality or accuracy of information presented on it. If you decide to visit a Third-Party Service, you are subject to its privacy policy and practices and not this Privacy Policy. We encourage you to carefully review the legal and privacy notices of all other digital services that you visit.

CALIFORNIA PRIVACY RIGHTS

Under Section 1798.83 of the California Civil Code, residents of California have the right to request from a business with whom the California resident has an established business relationship certain information with respect to the types of Personal Information the business shares with third parties for those third parties’ direct marketing purposes, and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. To exercise your rights, if you are a California resident, please e-mail us at legal@inhome.sylvanlearning.com with “Request for California Privacy Information” in the subject line and in the body of the e-mail. Be sure to include in the request sufficient information for us to identify you and/or your student.

MINORS

If you are a minor in your place of residence, you may use the Sites only with consent of your parent or legal guardian. Per the requirements of the Children’s Online Privacy Protection Act (COPPA, Sylvan In-Home does not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, please do not provide your contact information or any other Personal Information to Sylvan In-Home via the Sites or any other means. If we learn that we have collected information from a child under the age of 13 without first receiving consent from his or her parent or legal guardian, we will use the information only to inform the child that he or she cannot use the Sites and we will delete the information provided. If you are the parent or legal guardian or someone under the age of 13 who may have provided Sylvan In-Home with Personal Information without your knowledge or consent, please contact us at legal@inhome.sylvanlearning.com to have the information removed.

IMPLIED CONSENT UNDER CASL

Persons in Canada who contact us and/or provide their telephone number or email address are providing implied consent under Canada’s Anti-Spam Legislation (CASL) for us, our affiliate companies, and our Sylvan In-Home tutors to send them electronic marketing communications under CASL. See here for contact information for us, our affiliate companies, and our tutors, as required under CASL. If you do not wish to give this consent under CASL, please do not provide your telephone number or email address. You may cancel this implied consent at any time by opting out.

INTERNATIONAL USERS

The Sites is hosted in the United States and is governed by the laws of the State of Maryland of the United States. We recognize that it is possible for you to obtain access to the Sites from any jurisdiction in the world, but we have no practical ability to prevent such access. The Sites has been designed to comply with the laws of the State of Maryland of the United States – if any material on the Sites, or your use of the Sites, is contrary to the laws of the place where you are when you access the Sites, then the Sites is not intended for you and we ask you not to use the Sites. You are responsible for informing yourself of the laws of your jurisdiction and complying with them. If you are using the Sites from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located and our databases are operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Sites, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in our Privacy Policy.
